The new Rudd government is making good on some of it’s promises. See, there was a poorly named policy in place under Howard that took “asylum” seekers to remote islands for processing. The SCOTUS is looking at the legality of detaining people under combatant status. The Court heard a case Boumediene v Bush that the govt. defended as not worthy of being heard and that the detained individual was a keeper.
For the Supreme Court hearing arguments last week in Boumediene v. Bush, that should not even be a relevant issue. (Lakmar Boumediene is an Algerian who emigrated to Bosnia in the 1990s. He was arrested for plotting to attack the U.S. embassy in Sarajevo and turned over to the U.S military.) If it is lawful to imprison captured enemy operatives without trial until the end of hostilities, as it has been for centuries under the laws of war, then it should not matter how long they’ve been held. Thus did Solicitor General Paul Clement gamely counter that emphasizing the six-year delay serves only to “cloud the basic constitutional question before this Court.” WS
I personally agree with detaining those we find in combat situations on the fields of battle in Iraq and Afghanistan. I don’t agree with the military taking those into custody people from law enforcement pick ups in other geo- locations. This guy was essentially extradited to US custody for plotting a civil-terrorist attack. missteps like this discredit the military and causes anti-American groups to gain credibility on the issue.
If I can’t get a comment out of this menagerie I just don’t know.

I think that everyone is abusing the systems all the way from a parking ticket to the supreme court. Everyone is sue happy and in actuality the only ones that are happy at the end of the day is the attorneys, because they are making all the big bucks. They are the ones that have advertisements any hour of the day or night telling you who and why to sue. The judicial system has become a victim of itself, the medical community, the pharmaceutical companies as well as any other entity that offers anything up to the public. I agree, there are issue in some Muslim communities, especially the Kurdish one, with honour killings but when I looked into it worldwide I saw there were more honour killings per capita in the US, only they weren’t called honour killings they were killed spousal murders. There are no figures available in any western country for the number of adultery (or cheating on a partner) related homicides there are each year but I bet they would make interesting reading.
I don’t think any of this excuses Muslims who murder women in the name of Islam but domestic violence is “blind to colour or creed”.

I will tell you a couple of things. I’ve worked in health care and it’s pretty important to find the right time and place to eat. it’s calming,professional and hygienic. Another thing is that it wasn’t total and or direct orders. Last. The prison was Bagram. I think the uprising is a poor excuse, there has been an uprising at Gitmo and the US was never going to be overrun there.
The problem of overcrowding isn’t helped by the fact that Bagram was used as holding centre for detainees rendered from third countries. Most the people held in Gitmo weren’t picked up in theatre and all the prisoners released have been innocent.
The reality is that America had effectively kidnapped over 83,000 by 2005, and there are 35,000 detainees in Iraq, about 20,000 of those are in US custody and haven’t committed any crime, they’ll be released without charge and won’t provide useful Intel, the Americans are adopting internment as a coercive system, they nab men of a certain age to collectively punish the population. But when it’s in Iraq, it gets mentioned but it hardly gets noticed – it doesnt draw the heat that 35,000 detainees in Gitmo would.
I agree with you that Gitmo is more symbolic, there are less than 1000 detainees there.
Thanks Steph. I believe in safety nets not hammocks or nets that ensnare people. Over here that seems to be the thing we can’t work out. You get on public assistance and if you try to baby step off of it via getting a job etc. you get whacked with losing your aid. (that’s the snare) How the hell are people supposed to get off then ? On the other end I’ve personally seen people that essentially live their lives off the public roll. They pass their “wealth of knowledge” to their kids and they do it too. (that’s the hammock)
I believe in free ed,I ideally believe the private sector could use public funds and educate the kids better.Health care, my big issue is how litigation and subsidies have such an impact on the cost of health care keeping the costs up and preventing people getting it.

I think we partly disagree on the welfare state, I believe in social housing, free medical care (to a point), free education but I agree with your general point, that nannying is controlling and encourages social irresponsibility. The reason there are so many teenage girls deliberately getting pregnant in the UK, is because they can get a council flat and pick up income support for staying at home and not looking after their kids. The state is paying them to prostitute themselves. If the State didn’t, would so many underage girls be knocking out kids?
The story about a woman denied unemployment benefits because she wouldn’t work in a brothel is untrue but maybe it shouldn’t be. If these girls knew the moment they turned 18, they wouldn’t get benefit if they refused to work in a licenced brothel, I seriously doubt that so many of them would be getting pregnant.

I also think there are a number of stable and potentially stable governments around the globe that now more than ever have a willingness to question and imprison terrorists. How or if this war shifts with a new Administration is something we’ll need to wait and see.

It has always boggled my mind how those that say they care about people are seemingly the same people that help to assure the “safety net” that ensnares people. Nobody was prosecuted because the official age of consent is 16 but the de facto age of consent is 13 in the UK, there is virtually no chance that a man who has consensual sex with a 13 year old girl will be prosecuted unless she supports the prosecution. When my cousin was at Amie was at school, she felt she was told use contraception, and anal sex was as safe as vaginal sex. There are schools that want to dish out contraceptives in the class room. Maybe saying to a girl if you have sex before you’re legal you’re a slapper is what we should be doing, we shouldn’t be rewarding this. Lots of these girls get pregnant to get out of school so they can get a council flat and live off benefits.
Hey Steph thanks for stopping by. I would say the initial Afghanistan combat especially the uprising/assault at the overcrowded prison (name escapes me now) was a good impetus to start up Gitmo. The instability of the theatre prevented the “law enforcement” angle of further identifying Taliban/Al Qaeda. Hostilities are officially over in Iraq and Afghanistan, the US military has no legal right to detain any prisoner from those conflicts. They should have all already been released. It puzzles me why the Bush administration was so stupid, as to create Gizmo, they could have held every prisoner they captured in Iraq or Afghanistan, and released them into the custody of the Iraqi or Afghan governments, meaning they stay in the same jails. Anyone picked up from other geo locations ought to have due process under criminal law.

I was just stating a fact. Those that have been found back in theatre are obviously guilty of fighting. Seriously though people that believe they are fighting a war will tend to do that.I would also say that those that weren’t legit detainees get a pretty good impetus to be angry-angry enough to fight I don’t know.

Gitmo is meant for those identified as potential threats and credible holders of information. it’s not a prisoner of war camp as much as NYT and their allies want people to view it.
We clear people and they return to the battlefield. You do know what too, right? And whats a “timely” manner? We are at war, we dont have to release them till the war is over.
Im not to concerned about our postion globally. The world hates us no matter what. No matter what we do to please others, its not enough. But other nations get free pass after pass. I want us to win and could care less of world opinion, especially in the Islamic world.
My point being very case specific here. The guy in question was picked up by law enforcement in a sovereign nation. I would’ve liked to see a civil prosecution of this guy. I think it would’ve been of higher value to the US position globally.I also think this guy is of no value to us in Gitmo. I believe in Gitmo I just want the right people there. Gitmo has proven to be a bit of a SNAFU. We clear people,(MSM won’t tell you that) but not in a timely manner and then our repatriation efforts get jammed up.
